Uber files lawsuit against Colorado over new state transparency laws, claiming they infringe on free speech

A new lawsuit filed by Uber alleges that two Colorado laws aimed at improving transparency for ride-hailing and delivery app drivers infringe on the company’s right to free speech. The laws, Senate Bill 75 and House Bill 1129, require companies like Uber to show drivers how much customers will be charged and detail how much of that amount will go to the driver versus the company. Uber claims that the laws compel the company to express the state’s viewpoint that it does not adequately compensate its drivers, which goes against core First Amendment principles. The lawsuit also argues that the required disclosures do not provide a complete picture of Uber’s compensation structure by excluding information about tolls, fees, and insurance costs.

The lawsuit, filed in U.S. District Court in Denver, seeks a temporary restraining order to prohibit the enforcement of the laws, with SB-075 set to begin enforcement on Feb. 1 and HB-1129 already in effect since Jan. 1. The Colorado Independent Drivers Union criticized Uber’s legal maneuvering, stating that the laws are essential for ensuring transparency and fairness for drivers and consumers. The group argues that the laws will shed light on practices that may be unfairly skewed against drivers and consumers. A spokesperson for Governor Jared Polis declined to comment on the pending litigation. Stay updated on Colorado Politics by subscribing to their weekly newsletter, The Spot.
