New Resentencing Hearing Scheduled for Erik and Lyle Menendez in 1989 Murder Case on Dec. 11


Brothers Erik and Lyle Menendez, who have been in prison for 34 years for the murder of their parents in 1989, are set to have a resentencing hearing on December 11. Prosecutors have recommended a sentence of 50 years to life, which could make them immediately eligible for parole. Los Angeles County District Attorney George Gascón took into consideration factors such as their rehabilitation in prison and educational achievements when making this recommendation. The brothers’ attorneys argue that they acted out of self-defense due to years of emotional and sexual abuse by their father, which was largely excluded from their second trial.

While some family members advocate for the brothers’ release, others, including one of their uncles, believe they should remain in prison. The brothers have also filed a habeas petition to introduce new evidence not previously presented at their trial. Additionally, they have requested clemency from California Governor Gavin Newsom, who is reviewing the case.

The Menendez case gained renewed attention due to the Netflix drama “Monsters: Lyle and Erik Menendez Story.” Governor Newsom has acknowledged the case’s visibility and mentioned that his team has looked into Gascón’s decision. If the resentencing is approved, the brothers will still need approval from a state parole board and ultimately Governor Newsom for their release.
