The Supreme Court has ordered the Trump administration to facilitate the return of Kilmar Abrego Garcia, a Maryland man who was mistakenly deported to El Salvador. Abrego Garcia was arrested in March on alleged ties to the MS-13 gang, but there was no evidence to support this claim. He was deported despite having a protective order preventing expulsion from the U.S. The administration admitted that his deportation was a mistake due to an administrative error.
Supreme Court Chief Justice John Roberts put a hold on a previous order for Abrego Garcia’s return pending review. The court directed U.S. District Judge Paula Xinis to clarify her order to ensure it respects the executive branch’s authority in foreign affairs. The Justice Department emphasized the administration’s exclusive prerogative on foreign policy and criticized activist judges.
Abrego Garcia, a legal resident of the U.S., won a court order protecting him from deportation after a previous arrest in 2019. His attorney and family welcomed the Supreme Court’s decision, urging swift action to bring him back home. Abrego Garcia’s wife, Jennifer Vasquez Sura, expressed relief that the nightmare is coming to an end and vowed to keep fighting until her husband is reunited with their family in Maryland.
