Southwest Airlines Faces Lawsuit from U.S. Government for Persistent Flight Delays


The federal government has filed a lawsuit against Southwest Airlines, seeking over $2.1 million in civil penalties for consistently delayed flights in 2022 on routes between Chicago and Oakland, as well as Baltimore and Cleveland. The Transportation Department accused the airline of harming passengers and violating rules against operating unrealistic flight schedules. Southwest stated that the lawsuits were over flights that took place more than two years ago and that they had a strong performance record over the past 15 years. The lawsuit alleges that Southwest was responsible for over 90 percent of delays, causing disruptions for thousands of passengers.

Last year, Southwest canceled fewer than 1 percent of its flights, but over 22 percent arrived late by at least 15 minutes. The lawsuit was filed in the United States District Court for the Northern District of California, with the government citing numerous violations by Southwest that resulted in civil penalties totaling over $2.1 million. Frontier Airlines was also fined $650,000 for chronically delayed flights, with half the amount going to the Treasury and the rest potentially waived if there are no more violations in the next three years.

JetBlue Airways was ordered to pay a $2 million fine for failing to address similarly delayed flights, with half of the money going to affected passengers. The Transportation Department’s actions are intended to enforce passenger protections and ensure airlines operate reliable and realistic schedules. Southwest’s response to the lawsuit remains that the flights in question do not represent an unrealistic schedule.
