Dr. Phil McGraw and author John Grisham testified before Texas lawmakers, resulting in a halt to the execution of death row inmate Robert Roberson. The House Committee on Criminal Jurisprudence is reviewing a Texas law related to “junk science” convictions. Roberson was convicted of killing his 2-year-old daughter based on the debunked Shaken Baby Syndrome. Dr. Phil, who believes in the death penalty in some cases, testified that Roberson did not receive a fair trial, a sentiment supported by scientific experts and the lead detective who now admits he made mistakes.

Dr. Phil has extensively researched Roberson’s case, highlighting concerns about the forensic evidence. He believes the stakes are high because a wrongful conviction could jeopardize the death penalty. Grisham also testified in favor of Roberson’s innocence. Roberson’s daughter had pre-existing medical conditions, and the lead investigator admitted to biases that led to Roberson’s conviction.

The stay of Roberson’s execution was spurred by the committee’s subpoena to hear his testimony. Despite legal obstacles, the Texas high court granted a stay to allow Roberson to testify. Governor Greg Abbott filed a brief to prevent Roberson from testifying in person, citing his power to grant clemency.

The committee will continue to hear testimony, including from Roberson himself, although the state Attorney General’s Office is opposed to his in-person testimony. The case underscores issues with outdated medical science and bias in the criminal justice system, raising questions about the fairness of convictions based on flawed evidence.
