Lawsuit prompts residents to vacate Fitzsimons Place apartment in Aurora


More than 85 families living in a condemned Aurora apartment building were forced to leave their homes on Tuesday morning under a city order. One of the former tenants, Javier Hidalgo, has filed a lawsuit against the property owners and managers, citing deplorable living conditions. The lawsuit seeks housing for displaced residents and back rent for every tenant.

The property management company, CBZ Management, argued that problems at the building were caused by a transnational Venezuelan gang’s presence. The city of Aurora had taken legal action against the property owner, Zev Baumgarten, for longstanding code violations. The former tenants, many of whom are Venezuelan migrants, were given only six days to vacate the building.

Community organizers provided temporary shelter for displaced residents in hotel rooms. The city will cover the hotel stays through the end of August and help with security deposits for new housing. City officials did not grant another two months for residents to secure housing, despite protests from affected tenants.

The city plans to recover the money spent on abatement, security deposits, and hotel rooms from CBZ Management and its principals. The plight of the former tenants has highlighted issues of neglect in properties in the Denver metro area. The lawsuit and eviction have left many families homeless, prompting calls for the city to fulfill its promises to support those affected by the eviction.
